There are 27 numbers of amendments in United State constitution. In the United State constitution from 1 to 10 amendments are called “Bill of right”. There are other amendments what are used for the right of USA citizen and election or election terms related. The 21st is the exception amendment what is used revoking the 18th amendment. By the amendment, it is possible to fix the problem in the legal document, constitution, contract, and law. It is possible to bring change in one amendment by another amendment or use a clause to bring change in the amendment. In the document, constitution, contract, and law, it is not possible to erase. You can bring change or edit, add or remove anything from the document, constitution, contract and law by another clause.
The Twenty-second Amendment or the 22nd amendment or Amendment XXII is very important part of the United State constitution. This amendment is created related to the terms of the president duration. In the 22nd amendment, it is said about the restriction for the president to a maximum of two terms or 10 years. Duration of the presidency after winning the election is mentioned and the 22nd amendment is still valid and it is followed. The term of the service of the presidency is explained in this amendment. The 22nd amendment was passed by the congress on 21st March 1947 and February 27, 1951, in 48 states approved this amendment. Now the 22nd amendment applicable in United States.
It necessary to know the text of the 22nd amendment. The text of the 22nd amendment is divided into two sections. In these two sections, the rules of the election and term of the presidency are described. These two sections are given below and upcoming paragraph we will know the detail of the 22nd amendment.
Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this article shall not apply to any person holding the office of President when this article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this article becomes operative from holding the office of President or acting as President during the remainder of such term.
Section 2. This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several states within seven years from the date of its submission to the states by the Congress.
Some people from the congress were interested in making the tree terms for the presidency election but George Washington was against that decision. The two term duration fortification against of the empire and in the Farewell Address of the Washington decided not to stand for the reelection in 1792. He was not interested in being a president for the third time in 1796. He did not want to be president not for the age. He did not want it as an example by doing this to be a president for the 3rd time. After 11 years of this incident, Thomas Jefferson who is known as American Founding Father and the principal author of the Declaration of Independence wrote principle to the convention of a voluntary two-term limit in 1807. Then some people from the congress supported it and some people opposed.
James Madison and James Monroe were Jefferson’s immediate inheritors. They agreed and obeyed to the principle of two-term principle as well. After several years later, Andrew Jackson sustained the principle in a new political atmosphere. Then Franklin D. Roosevelt (FDR) American statesman and political leader and some other leaders were interested in making the 3 terms. Ulysses S. Grant was the 18th president of the US who was interested in being a president for the 3rd time. In 1880, after serving as a president from 1869 to 1877, but he could not win in the election from his party. Narrowly he failed from his party and James Garfield was chosen for the election for the presidency. But he could not be a president and Theodore Roosevelt became a full term president from 1901 to 1909. He wanted to be president for the non-consecutive third term by the election in the election of 1912, but he lost to Woodrow Wilson. Thomas Dewey declared support of the 22nd amendment that he would limit future presidents to two terms. He announced at end of the 1944 campaign for the election of the presidency. Finally, the 22nd amendment was passed. The Republican-controlled 80th Congress and permitted 22nd Amendment in March 1947. For few years, the amendment was not applied and Harry S. Truman decided for the reelection.
The 22nd amendment was approved in all of the states in different times and different years. Oklahoma and Massachusetts rejected the amendment and Arizona, Kentucky, Rhode Island, Washington and West Virginia had no action on this 22nd amendment. Those states accepted the 22nd amendment are Maine, Michigan, Iowa, Kansas, New Hampshire, Delaware, Illinois, Oregon, Colorado, California, New Jersey, Vermont, Ohio, Wisconsin, Pennsylvania, Connecticut, Missouri, Nebraska, Virginia, Mississippi, New York, South Dakota, North Dakota, Louisiana, Montana, Indian, Idaho, New Mexico, Wyoming, Arkansas, Georgia, Tennessee, Texas, Nevada and Utah .The amendment was subsequently ratified by the following states: North Carolina, South Carolina, Maryland Florida, Alabama.
The amendment was not applied to the sitting president at the time it was proposed by Congress. Harry S. Truman served near to the Franklin D. Roosevel who unexpired the fourth term. In 1948, he was elected for the full term. For the poor performance, he was not selected for the party and he could not join for the election but he was eligible for the next term election. However, since then the 22nd amendment is running without any barrier.
As it is related to the election and term of the presidency, US citizen should know and learn about the 22nd amendment and another related amendment.
